Terms of Service

These Terms of Service ("Terms") govern your use of the Againly desktop application and website operated by Againly ("we", "us", "our"). By downloading or using Againly, you agree to these Terms.

1. Service description

Againly is an AI-guided Windows automation tool that diagnoses software issues and, upon payment, executes automated corrections. The diagnosis phase is free. Automation execution requires an Automation Pack purchase or an IT Provider agreement.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use Againly. If using Againly on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Accounts and authentication

An account is required to execute automations. You are responsible for maintaining the security of your account credentials. Notify us immediately at privacy@againly.io if you suspect unauthorised access.

4. Payments and Refunds

4a. Automation Packs

Automation Packs are one-time purchases of automation credits. You will see the automation plan before you are charged. If the automated correction fails to resolve the described issue, you qualify for our 30-day success guarantee.

4b. IT Provider Solutions

IT Provider licensing is tailored for businesses and IT service providers managing multiple endpoints. These are governed by separate master service agreements.

4c. Taxes

You are responsible for any applicable local taxes on purchases.

5. Usage Limits

You agree not to exceed the usage limits of your plan:

• Automation Packs: one charge per distinct issue, credits never expire
• IT Provider: licensing for professional use on managed fleet machines

Using Againly to diagnose or modify machines you do not own or are not authorised to access is prohibited.

6. Acceptable use

You may not use Againly to:

• Interfere with other users' systems or the Againly service
• Attempt to reverse-engineer the AI model or automation engine
• Use the service for any unlawful purpose
• Circumvent payment or entitlement checks
• Automate system changes on machines without proper authorisation

7. Intellectual property

Againly and all associated software, AI models, and branding are the exclusive property of Againly. You are granted a limited, non-exclusive, non-transferable licence to use the software for its intended purpose.

8. Limitation of liability

Againly is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Changes to these Terms

We may update these Terms at any time. We will notify registered users by email at least 14 days before changes take effect for material changes. Continued use constitutes acceptance.
